Overview
Welcome to Arctos Ice. The terms “we”, “us” and “our” refer to Arctos Ice Recovery Sports Equipment Trading L.L.C. S.P.C, trading as Arctos Ice. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify.

These Terms of Service, together with our Refund Policy and Privacy Policy (the “Terms”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information on health and safety, warranties and limitation of liability.

By visiting, using or buying from our Services, you agree to these Terms. If you do not agree, please do not use the Services.

By placing an order, you confirm that you have read and accept these Terms, our Refund Policy and the safety instructions in section 7.

1. Access and account
By using the Services, you confirm that you are at least the age of majority in your country of residence. You agree to provide correct, current and complete information, such as your name, email address, delivery address and payment details.

You are responsible for keeping your account login details safe and for all activity on your account. You may not transfer your account to anyone else.

2. Our products
We make every effort to show our products accurately. Colours and finishes may look different on your screen, and natural materials such as cedar and pine vary in grain and tone, so no two products are exactly alike.

Product descriptions, specifications and availability may change without notice. We may discontinue any product and limit quantities per customer, region or order.

3. Orders
When you place an order, you make an offer to buy. Your order is accepted only once we confirm it and have received your payment. We may decline any order at our discretion, in which case we will contact you and refund any amount paid.

Once your order is confirmed, it is final. Returns, exchanges and refunds are handled only as set out in our Refund Policy.

Products sold through our website are for your own use. Resale is not permitted without our written agreement.

Gyms, studios, hotels and other businesses are welcome to contact us for project orders. These may be made under a separate written agreement or quotation, which takes priority over these Terms where the two differ.

4. Prices and payment
Prices are shown in AED and may change without notice. The price you pay is the price shown at checkout and in your order confirmation. Any delivery and installation charges are shown before you pay. For orders delivered outside the UAE, customs duties, import taxes and local charges are paid by you.

You confirm that the payment details you provide are correct and that you are authorised to use the payment method. If you pay in instalments with Tabby or Tamara, their own terms also apply to that payment.

5. Delivery and installation
Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, weather or other events outside our control, but we will keep you informed.

Before delivery, please make sure the site is ready: clear access for large items, a stable and level surface, a suitable power supply and, for Ice Baths, water supply and drainage. If our team cannot deliver or install because the site is not ready, additional charges may apply.

Within the UAE, ownership and risk pass to you when you sign the delivery confirmation. For orders shipped by courier, they pass to you on delivery. Please check your order at delivery as described in our Refund Policy.

6. Warranty
Our products come with a limited warranty against manufacturing defects:

• 12 months on Ice Baths, Ice Bath tubs, Saunas and the Red Light Face Mask
• 2 years on Red Light panels (Face Panel and Full Body Panel)

The warranty starts on the delivery date. If a covered defect appears, contact us and we will repair or replace the product, using a certified technician arranged by us.

The warranty does not cover misuse, use that does not follow the user manual, installation, modification or repair not carried out or approved by us, poor water quality or maintenance, weather damage, accidental damage or normal wear and tear. This warranty does not affect your statutory rights.

7. Health and safety
Ice Baths, Saunas and Red Light Therapy are intense experiences, and they are not right for everyone. Please read the user manual and safety instructions before your first session.

Speak to your doctor before use if you are pregnant, have a heart condition, high or low blood pressure, circulation problems, epilepsy, or any other medical condition, or if you take medication. Do not use our products under the influence of alcohol or drugs. Children must always be supervised by an adult. Never use an Ice Bath or Sauna alone if you feel unwell, and stop immediately if you feel dizzy, numb or uncomfortable.

Our products support general wellbeing and recovery. They are not medical devices intended to diagnose, treat or cure any condition, and the information on our website, including our Learn pages and research references, is general information and not medical advice.

If you use our products in a business, such as a gym, spa, studio or hotel, you are responsible for supervising your guests and members, displaying safety guidance and making sure our products are used safely at your premises.

8. Limitation of liability
You use our products at your own risk and are responsible for using them safely and as instructed. To the extent permitted by law, Arctos Ice is not liable for injury, illness, loss or damage resulting from:

• misuse, or use that does not follow the user manual and safety instructions
• use against medical advice, or by people for whom it is not suitable
• installation, modification or repair not carried out or approved by Arctos Ice
• unsupervised use by children
• normal wear and tear, or damage from water quality, weather or poor maintenance

To the extent permitted by law, our total liability for any claim is limited to the price paid for the product concerned. We are not liable for indirect or consequential loss, such as loss of income, profit or opportunity.

Nothing in these Terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

9. Relationship with Shopify
Arctos Ice is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Arctos Ice. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Arctos Ice, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Arctos Ice.

10. Privacy
All personal information we collect is handled in line with our Privacy Policy. Because our store is hosted by Shopify, some information is also processed by Shopify under the Shopify Privacy Policy.

11. Intellectual property
All content on the Services, including our name, logo, product names, text, images, videos and design, belongs to Arctos Ice or its licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, publish or use any of our content or trademarks without our written permission.

12. Reviews, photos and feedback
If you send us reviews, photos, ideas or other feedback, you allow us to use, edit and publish them, free of charge, to operate and promote our Services. Where a photo or quote shows you or your home, we will ask before publishing it with your name. You confirm that anything you send us is yours to share and does not break any law or anyone else’s rights.

13. Third-party tools and links
The Services may include third-party tools and links to other websites, such as payment providers and social media. We do not control them and are not responsible for their content, products or practices. Please review their terms before using them.

14. Errors and changes
Our website may occasionally contain errors in product details, prices or availability. We may correct them at any time and, if a price or product detail was wrong, cancel an affected order and refund you in full, even after it was placed.

15. Prohibited use
You may use the Services for lawful purposes only. You may not misuse the Services, including by sending false information, impersonating others, uploading malicious code, scraping the site, interfering with its security or harassing our team or other customers. We may suspend or close your account if you break these Terms.

16. Indemnity
You agree to cover any losses, claims or costs, including reasonable legal fees, that Arctos Ice or Shopify suffer because you broke these Terms or the law, or violated someone else’s rights.

17. General
If any part of these Terms is found to be invalid, the rest remains in force. If we do not enforce a right, we do not give it up. These Terms are the entire agreement between you and us for your use of the Services. You may not transfer your rights under these Terms without our written consent. We may transfer ours, for example as part of a sale of our business. Headings are for convenience only. If these Terms are translated into another language, the English version prevails to the extent permitted by law.

18. Governing law
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi. Any dispute will be handled by the courts of Abu Dhabi. If you are a consumer in the European Union or the United Kingdom, you also keep the protection of the mandatory laws of your country of residence.

19. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page, and changes apply from the date they are posted. Continuing to use the Services after a change means you accept the updated Terms.
